There are a number of factors which can affect
the size of an award. For example, in cases
where several manufactures of asbestos products
can be sued, then generally the award will be
more. The jurisdiction, or place, where a case
can be sued is also a critical factor. States
like New York,
Texas and California tend to have the highest
awards. Even if you do not live in one of these
states, we can often find a legitimate
jurisdictional basis to sue the case there. For
example, one of our clients,
Vincent, lives in Pennsylvania, but we were
able to bring his lawsuit in Texas, because the
majority of his exposure to asbestos products
occurred in Texas. Juries in these states tend
to be more familiar with the devastation that
was caused by asbestos products, and juries tend
to be more liberal in awarding money. In
mid-western states, juries tend to be much more
conservative in the amount of money they award.
Additionally, some states do not allow for
punitive damages in asbestos cases.
